Article 1 – Definitions

  • Matdesign: Matdesign Bierviltjes B.V., Industrieweg 10, 6662 PA Elst, the Netherlands, Chamber of Commerce no. 67 302 742.
  • Customer: any natural or legal person who requests a quote or places an order.
  • Consumer: a customer who is not acting in the course of a profession or business.
  • Agreement: any arrangement between Matdesign and the customer for the supply of products or services.
  • Proof: the digital preview of the design that Matdesign sends to the customer for approval.

Article 2 – Applicability

These terms apply to all quotes, orders and agreements of Matdesign. Deviations only apply if we have confirmed them in writing. The customer's general terms and conditions do not apply.

Article 3 – Quotes and prices

Quotes and prices on the website are without obligation, unless stated otherwise. Prices for business customers exclude VAT; prices for consumers include VAT. Any shipping, rush or setup costs are stated in advance. Obvious errors do not bind Matdesign.

Article 4 – Formation of the agreement

The agreement is concluded as soon as Matdesign has confirmed an order or order request in writing or by email. Production only starts after the customer has approved the proof.

Article 5 – Supplied files and designs

The customer is responsible for the content of supplied files, texts and images and guarantees that they hold the necessary rights. The customer indemnifies Matdesign against third-party claims, for example for infringement of copyright or trademark rights. The customer may use designs created by Matdesign for the ordered products.

Article 6 – Proof and deviations

Once the proof has been approved, the customer is responsible for any errors in it, such as spelling or grammar mistakes. Colours on a screen may differ from the printed result. Minor deviations in colour, size and cutting line that are customary in the printing industry do not entitle the customer to a reprint or compensation.

Article 7 – Delivery

Delivery and shipping dates are indicative and not strict deadlines. In the event of a significant delay, we will inform the customer as soon as possible. The risk of the products passes to the customer at the moment of delivery. Collection from our location in Elst is possible.

Article 8 – Payment

Payment is made by invoice within 14 days of the invoice date, unless agreed otherwise. In the event of late payment, the customer owes statutory interest without further notice of default and, for business customers, reasonable collection costs. For consumers, the statutory rules on collection costs apply.

Article 9 – Right of withdrawal

Beer coasters are made to the customer's specifications. Consumers therefore have no right of withdrawal for these personalised products (Article 6:230p(f) of the Dutch Civil Code). Free samples do not need to be returned.

Article 10 – Complaints

The customer inspects the products immediately upon receipt. Complaints about visible defects must be reported within 8 days of delivery by email to [email protected], preferably with photos. If the complaint is justified, Matdesign will choose between a reprint, a supplementary delivery or a (partial) credit. A complaint does not suspend the payment obligation. Consumers' statutory rights remain unaffected.

Article 11 – Liability

Matdesign's liability is limited to the invoice amount of the order concerned. Matdesign is not liable for indirect damage, such as consequential loss, lost profit or damage due to delay. These limitations do not apply in the event of intent or deliberate recklessness on the part of Matdesign.

Article 12 – Retention of title

Delivered products remain the property of Matdesign until the customer has paid all amounts under the agreement in full.

Article 13 – Force majeure

In the event of force majeure, such as production failures, illness or problems at suppliers or carriers, we are not obliged to perform for as long as the force majeure lasts. If the force majeure lasts longer than 30 days, either party may terminate the agreement free of charge.

Article 14 – Privacy

Matdesign processes personal data in accordance with the privacy policy.

Article 15 – Applicable law and disputes

All agreements are governed by Dutch law. Disputes will be submitted to the competent court of the District Court of Gelderland (the Netherlands). Consumers retain the protection offered to them by the mandatory law of their country of residence.
